AD: Korea Stainless Steel Wire Rod

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of stainless steel wire rod from Korea for the period of September 1, 2004 through August 31, 2005.

AD Cash Deposit Instructions for a Time of Entry on or after 02/12/07:

(a) For previously reviewed or investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;

(b) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(c) The AD duty cash deposit rate for all other manufacturers or exporters will continue to be 5.19%, the "all others" rate from the amended final determination.

1ITA sources state that although POSCO is not mentioned in the final results, it is included in the Changwon/Dongbang collapsed entity.

Assessment Instructions for the Review Period (09/01/04 - 08/31/05)

The ITA states that it intends to issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of February 12, 2007.

Additionally, the ITA states that it calculated an importer/customer-specific assessment rate or per-unit value for subject merchandise, which trade sources note may differ significantly from the AD cash deposit rate listed above (which is a weighted average).

The ITA adds that for entries of subject merchandise during the review period produced by the companies included in these final results of review for which the reviewed companies did not know that the merchandise it sold to the intermediary was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the "all-others" rate if there is no rate for the intermediary involved in the transaction.
