AD: China Certain Polyester Staple Fiber

The International Trade Administration (ITA) has made a preliminary affirmative antidumping (AD) duty determination that certain polyester staple fiber from China is being, or is likely to be, sold in the U.S. at less than fair value. The period of investigation is October 1, 2005 - March 31, 2006.

Preliminary critical circumstances for Far Eastern. The ITA has preliminarily determined that critical circumstances exist for imports of subject merchandise for Far Eastern Industries (Shanghai) Ltd. (Far Eastern). Therefore, the ITA states that for Far Eastern, it will direct U.S. Customs and Border Protection (CBP) to suspend liquidation of entries of subject merchandise with a time of entry on or after 90 days prior to December 26, 2006.

The ITA has preliminary determined that critical circumstances do not exist for imports of subject merchandise for all other exporters/producers listed below.

Suspension of liquidation, AD cash deposit. The ITA will instruct CBP to suspend the liquidation of entries of subject merchandise with a time of entry on or after December 26, 2006 for all exporters/producers listed below, other than Far Eastern (see above).

The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates (equal to the weighted-average AD margins) listed below, for entries of subject merchandise from China for the following exporters/producers and the China-wide entity:

Final AD Duty Determination

The ITA states that it will make its final AD duty determination for subject merchandise from China no later than 75 days after December 26, 2006.

(Everest Textile), Far Eastern Industrial (Suzhou) Ltd. (FEIZ), Far Eastern Industrial (Wuxi) Ltd. (FEIW) and Far Eastern Textiles (Taiwan) Ltd.'s (FETL), in addition to FETL's other related parties. The ITA also preliminarily finds that it is not necessary to collapse Far Eastern with its affiliates because there is no record evidence demonstrating that there is significant potential for manipulation of price or production with its affiliates.
