ITA Preliminary Determines Subject Entities are Successors-in-Interest to Ivaco

The ITA has preliminarily determined that (1) Ivaco Rolling Mills 2004 L.P. is the successor-in-interest to Ivaco Rolling Mills L.P.; and (2) Sivaco Ontario, a division of Sivaco Wire Group 2004 L.P., is the successor-in-interest to Ivaco Inc. As a result, Ivaco Rolling Mills 2004 L.P., and Sivaco Ontario, a division of Sivaco Wire Group 2004 L.P., (collectively, Ivaco) should receive the same AD duty treatment with respect to carbon and certain alloy steel wire rod from Canada as Ivaco Rolling Mills L.P. and Ivaco Inc.

(The ITA states that Ivaco notified the ITA that the assets of Ivaco, Inc. and all of its divisions (e.g., Sivaco Ontario and Sivaco Quebec) had been purchased on December 1, 2004. As a result, the ITA self-initiated a changed circumstances review of the AD duty order on carbon and certain alloy steel wire rod from Canada.)

If these preliminary results are affirmed in the final results, the ITA will apply the AD cash deposit rate from this changed circumstances review to all entries of the subject merchandise by Ivaco Rolling Mills 2004 L.P., and Sivaco Ontario, a division of Sivaco Wire Group 2004 L.P., with a time of entry on or after the date of publication of the final results of this AD changed circumstances review.

- the ITA will issue the final results of this AD duty changed circumstances review no later than 270 days after October 31, 2006.

(See ITA notice for more information, including the scope of the order, etc. See ITT's Online Archives or 11/13/06 news, 06111310, for BP summary of the initiation of this changed circumstances review.)
