AD: Taiwan Stainless Steel Sheet and Strip in Coils

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of cut-to-length carbon steel plate from China for the period of November 1, 2004 through October 31, 2005.

AD Cash Deposit Instructions for a Time of Entry on or after 12/18/06:

(a) For previously reviewed or investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;

(b) If the exporter is not a firm covered in this review, a prior review, or the AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise;

(c) If neither the exporter nor the manufacturer is a firm covered in these or any previous reviews conducted by the ITA, the AD duty cash deposit rate will be the "all-others" rate, which is 12.61%.

Assessment Instructions for the Review Period (07/01/04 - 06/30/05)

The ITA states that it will issue appropriate assessment instructions for subject merchandise directly to U.S. Customs and Border Protection (CBP) within 15 days of December 15, 2006.

Additionally, the ITA states that for Chia Far, it calculated importer-specific assessment rates. For all other reviewed companies, the assessment rate is based upon adverse facts available (AFA), and the ITA will instruct CBP to liquidate entries for those companies according to the AFA ad valorem rate of 21.10%.

The ITA adds that for entries of subject merchandise during the review period produced by companies included in these final results where the companies did not know their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the "all-others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
