AD: Thailand Canned Pineapple Fruit

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of canned pineapple fruit from Thailand for the period of July 1, 2004 through June 30, 2005.

(a) For previously investigated or reviewed companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate for the most recent period;

(b) If the exporter is not a firm covered in this review, a prior review, or the AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise;

(c) The AD duty cash deposit rate for all other manufacturers or exporters will continue to be the "all-others" rate of 24.64%.

Assessment Instructions for the Review Period (07/01/04 - 06/30/05)

The ITA states that it will issue appropriate assessment instructions for subject merchandise directly to U.S. Customs and Border Protection (CBP) within 15 days of December 7, 2006.

Additionally, the ITA states that for Vita, it calculated importer/customer-specific duty assessment rates. For TROFCO, the ITA and sources state that the assessment rate is based upon adverse facts available (AFA), and it will instruct CBP to liquidate entries for TROFCO according to the AFA ad valorem rate of 51.16%.

The ITA adds that where the reviewed companies did not know their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the "all-others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
