AD: Taiwan Certain Polyester Staple Fiber
The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of certain polyester staple fiber from Taiwan for the period of May 1, 2004 through April 30, 2005.

(a) For merchandise exported by manufacturers or exporters not covered in this review but covered in the original less-than-fair-value investigation, the AD duty cash deposit rate will continue to be the most recent rate published in the final determination for which the manufacturer or exporter received an individual rate;
(b) If the exporter is not a firm covered in this review or the original investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise;
(c) If neither the exporter nor the manufacturer is a firm covered in this review, the AD duty cash deposit rate will be 7.31%, the "all-others" rate established in the Amended Final Determination.
Assessment Instructions for the Review Period (05/01/04 - 04/30/05)
The ITA states that it will issue appropriate assessment instructions for subject merchandise directly to U.S. Customs and Border Protection (CBP) within 15 days of October 13, 2006.
Additionally, the ITA states it calculated importer-specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the AD cash deposit rates listed above (which is a weighted average).
The ITA adds that where FET did not know the merchandise it produced was destined for the U.S., the ITA will instruct CBP to liquidate such unreviewed entries at the "all-others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
