AD: China Certain Activated Carbon

The International Trade Administration (ITA) has made a preliminary affirmative antidumping (AD) duty determination that certain activated carbon from China is being, or is likely to be, sold in the U.S. at less than fair value. The period of investigation is July 1, 2005 -- December 31, 2005.

Combination rates. The ITA states that it has calculated exporter/supplier combination rates for certain respondents that are eligible for a separate rate in this AD duty investigation. (See ITT's Online Archives or 04/11/05 news, (Ref: 05041110), for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates. This policy bulletin also announced a new application process for obtaining separate rates.)

Suspension of liquidation, AD cash deposit. The ITA will instruct U.S. Customs and Border Protection (CBP) to suspend the liquidation of entries of subject merchandise with a time of entry on or after October 11, 2006. The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates (equal to the weighted-average AD margin) listed below, for entries of subject merchandise from China for the following exporter/supplier combinations and the China-wide entity:

1 The ITA is not including Ningxia Haoqing Activated Carbon Co., Ltd. (HQG) or Ningxia Guanghua Activated Carbon Co., Ltd. (GH) in the combination rate for Calgon Carbon Tianjin Co., Ltd. (CCT) as both HQG and GH are trading companies who sold other companies' merchandise to CCT during the period of investigation.

2 The ITA preliminarily finds that Jacobi Tianjin International Trading Co., Ltd. (Jacobi Tianjin), Jacobi Carbons AB (Jacobi AB) and Jacobi Carbons Inc. (Jacobi US) (collectively, Jacobi) are affiliated, and the weighted-average margin of 49.09% for Jacobi Carbons AB applies to exports made by Jacobi Tianjin.

(Note that the AD duty margin for the separate rate respondents is 72.52%.)

Postponement of Final AD Duty Determination

In addition, the ITA states that it is postponing its final AD duty determination for subject merchandise from China until no later than 135 days after October 11, 2006 and is also extending the provisional measures accordingly.
