AD: Brazil Certain Small Diameter Seamless Carbon and Alloy Steel Standard, Line and Pressure Pipe

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of certain small diameter seamless carbon and alloy steel standard, line and pressure pipe from Brazil for the period of August 1, 2004 through July 31, 2005.

AD Cash Deposit Instructions for a Time of Entry on or after 09/27/06:

(a) The ITA has found that an AD duty rate of zero exists for VMB; as a result, no AD cash deposit is required; however, suspension of liquidation will continue;

(b) For merchandise exported by producers or exporters not covered in this review but covered in the investigation, the cash deposit rate will continue to be the company-specific rate from the final determination;

(c) If the exporter is not a firm covered in this review or the investigation, but the producer is, the cash deposit rate will be that established for the producer of the merchandise for the most recent period; and

(d) If neither the exporter nor the producer is a firm covered in this review or the investigation, the AD duty cash deposit rate will be 124.94%, the "all others" rate established in the AD investigation.

Assessment Instructions for the Review Period (08/01/04 - 07/31/05)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of September 27, 2006.

Additionally, the ITA states that it calculated importer-specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the AD cash deposit rate listed above (which is a weighted average).

The ITA adds that in certain situations where VMB did not know its merchandise was destined for the U.S., the ITA will instruct CBP to liquidate such unreviewed entries at the "all others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
