AD: China Certain Preserved Mushrooms

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of certain preserved mushrooms from China for the period of February 1, 2004 through January 31, 2005.

The ITA finds that each of the three companies listed above did not establish entitlement to a separate rate and are thus part of the China-wide entity for this AD review. According to ITA sources and certain CBP administrative messages, as a result (1) PHX has lost its separate AD duty rate of 67.79% and instead is subject to the China-wide rate of 198.63%, and (2) Gerber and Guangxi Yulin continues to receive the China-wide rate of 198.63%.

(a) For any previously reviewed or investigated China or non-China exporter not covered in this AD review, with a separate rate, the AD cash deposit rate will be the company-specific rate established in the most recent segment of those AD proceedings;

(b) For all other China exporters, the AD cash deposit rates will be the China-wide rate established in the final results of this review; and

(c) The AD cash deposit rate for any non-China exporter of subject merchandise from China who does not have its own rate will be the rate applicable to the China exporter that supplied the non-China exporter.

Assessment Instructions for the Review Period (02/01/04 - 01/31/05)

The ITA will issue appraisement instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of July 17, 2006.
