ITA to Determine if Taiga Building Products Ltd. is Successor-in-Interest
In its request, Taiga Building Products Ltd. argues that it changed its name to Taiga Building Products Ltd. from Taiga Forest Products, and that the company's ownership, senior management, operations, supplier/customer relationships, and facilities have not changed. As such, Taiga Building Products Ltd is, for all intents and purposes, operating in the exact same manner as Taiga Forest Products.
According to the ITA, this constitutes changed circumstances warranting a review of the AD order. Therefore, the ITA is initiating a changed circumstances review based upon the information contained in Taiga Building Products Ltd.'s submission.
The ITA states that if the evidence demonstrates that, with respect to the production and sale of the subject merchandise, the new company operates as the same business entity as its predecessor, the ITA will assign the new company the AD cash-deposit rate of its predecessor (currently 3.78% for Taiga Forest Products).
ITA sources add that the current AD cash deposit rate for Taiga Building Products Ltd., which is the "All Others" rate of 11.54%, will continue unless and until it is modified pursuant to the final results of this AD duty changed circumstances review.
- the ITA will publish a notice of its preliminary results of this AD duty changed circumstances review in the Federal Register and will issue its final results not later than 270 days after July 7, 2006
(See ITA notice for more information including the scope of the order, etc.)
