AD: Korea Stainless Steel Sheet and Strip in Coils

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty changed circumstances review of stainless steel sheet and strip in coils from Korea.

Hyundai Steel Company is the successor-in-interest. The ITA has determined that Hyundai Steel Company (Hyundai) is the successor-in-interest to INI Steel Company (INI), formerly Inchon Iron and Steel Co., Ltd. (Inchon). According to the ITA, Hyundai's organizational structure, management, production facilities, supplier relationships, and customers have remained essentially unchanged since its name change from INI. Further, the ITA finds that Hyundai operates as the same business entity as INI.

Hyundai (as producer and exporter) excluded from AD duty order. The ITA also determined that because INI (as producer and exporter)is excluded from the AD duty order on subject merchandise from Korea, merchandise produced and exported by Hyundai should be excluded from the AD duty order.

As a result, the ITA states that it will apply this determination retroactively and will instruct U.S. Customs and Border Protection (CBP) to liquidate, without regard to AD duties, all unliquidated entries of subject merchandise produced and exported by Hyundai with a time of entry on or after March 10, 2006, the date of INI's name change to Hyundai.
