AD: China Certain Lined Paper Products

The International Trade Administration (ITA) is amending its preliminary affirmative antidumping (AD) duty determination on certain lined paper products from China in order to, among other things, correct significant ministerial errors with respect to the AD duty margin calculation for Lian Li.

The ITA notes that this correction also affects the margin applied to companies for which the ITA preliminarily granted separate-rate status.

ITA preliminarily grants separate-rate status to You-You Paper. The ITA has also amended its preliminary determination in which it denied separate-rate status to You-You Paper and will preliminarily grant separate rate status to You-You Paper because the ITA overlooked documentation included in You-You Paper's separate-rate application.

Excel Sheen included in preliminary critical circumstances finding for China entity. In addition, although no party commented on this issue, the ITA is amending its preliminary finding of negative critical circumstances with respect to Excel Sheen. The ITA states that because it preliminarily denied separate-rate status to Excel Sheen, that company was considered part of the China entity. The ITA preliminarily found affirmative critical circumstances for the China entity. Therefore, the ITA's preliminary finding of critical circumstances for the China entity includes Excel Sheen.

Post bond or cash deposit. The ITA states that the collection of bonds or cash deposits and suspension of liquidation will be revised accordingly for the affected combinations. The ITA's amendments are expected to be effective for entries of subject merchandise with a time of entry on or after June 1, 2006, as follows:

BP is checking with ITA sources as to why You-You Paper's previous rate is listed as 135.02% when it was previously subject to the China-wide entity rate of 258.21%.
