AD: China Certain Artist Canvas

The International Trade Administration (ITA) has issued an antidumping (AD) duty order on certain artist canvas from China.

Combination rates. In the initiation notice for this AD duty investigation, the ITA stated that it would calculate exporter/producer combination rates for certain respondents that are eligible for a separate rate in this AD duty investigation. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates.)

AD liability, suspension of liquidation (with gap period for May 6-16, 2006). The ITA will direct U.S. Customs and Border Protection (CBP) to continue to suspend liquidation on all entries of subject merchandise from China with a time of entry on or after November 7, 2005 (the date of publication of the preliminary AD duty determination) through May 5, 2006.

The ITA states it will direct CBP to terminate the suspension of liquidation, and to liquidate without regard to AD duties, entries of subject merchandise from China with a time of entry from May 6, 2006 through May 16, 2006 as these entries are not liable for the assessment of AD duties. (The ITA is taking this action pursuant to 19 USC 1673b(d), which indicates that suspension of liquidation based on a preliminary determination may only remain in effect for four months.)

In addition, for entries with a time of entry on or after May 17, 2006 (the date of publication of the International Trade Commission's (ITC) final AD injury determination), suspension of liquidation will be reinstated and CBP officers will require an AD cash deposit as listed below.

Cash deposit only. According to the ITA, CBP will require, at the same time as importers would normally deposit estimated duties on this merchandise, an AD cash deposit at the rates (weighted average margins) listed below, for entries with a time of entry on or after May 17, 2006:
