The ITA will direct U.S. Customs and Border Protection (CBP) to continue to suspend liquidation and to assess AD duties upon further instruction by the ITA, on all entries of subject merchandise from Japan with a time of entry on or after August 18, 2005 (the date of publication of the preliminary AD duty determination) through December 15, 2005.

The ITA states it will also direct CBP to terminate the suspension of liquidation of entries of subject merchandise from Japan with a time of entry from December 16, 2005 through December 19, 2005 as these entries are not liable for the assessment of AD duties. (The ITA states that it is taking this action pursuant to 19 USC 1673b(d), which indicates that suspension of liquidation based on a preliminary determination may only remain in effect for four months in this case.)

In addition, ITA notes that for entries with a time of entry on or after December 20, 2005 (the date of publication of the International Trade Commission's (ITC) final AD injury determination), liquidation will be reinstated and CBP officers will require, at the same time as importers would normally deposit estimated duties, an AD cash deposit equal to the AD weighted average margin listed below:

(See ITA duty order notice for more information, including the scope of the order (which is unchanged from the final affirmative AD duty determination notice), etc. See ITT's Online Archives or 11/02/05 news, 05110225, for BP summary of the final affirmative AD duty determination for this investigation.)
