AD: China Certain Artist Canvas
The International Trade Administration (ITA) has made a preliminary affirmative antidumping (AD) duty determination that certain artist canvas from China is being, or is likely to be, sold in the U.S. at less than fair value.

Combination rates. In the initiation notice for this AD duty investigation, the ITA stated that it would calculate exporter/producer combination rates for certain respondents that are eligible for a separate rate in this AD duty investigation. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates. This policy bulletin also announced a new application process for obtaining separate rates.)
Liquidation suspended. The ITA states that it will instruct U.S. Customs and Border Protection (CBP) to suspend liquidation of all entries of subject merchandise with a time of entry on or after November 7, 2005. The ITA notes that this suspension of liquidation will remain in effect until further notice.
Post bond or cash deposit. The ITA is also instructing CBP to require a cash deposit or posting of a bond at the AD duty rates (equal to the weighted-average margin) listed below, for entries with a time of entry on or after November 7, 2005:

ITA Amends Scope of Investigation, Will Issue Preliminary Finding on One Type of Canvas
Amended scope of investigation. In the scope comments to this AD duty preliminary determination, the ITA notes that for this preliminary determination, it has made determinations with respect to whether artist canvas kits, paint-by-number artist canvas, bleached canvas, and splined canvas are included within the scope of investigation.
The ITA has amended the scope of investigation to read as follows:
The products covered by this investigation are artist canvases regardless of dimension and/or size, whether assembled or unassembled, that have been primed/coated, whether or not made from cotton, whether or not archival, whether bleached or unbleached, and whether or not containing an ink receptive top coat. Priming/coating includes the application of a solution, designed to promote the adherence of artist materials, such as paint or ink, to the fabric. Artist canvases (i.e., pre-stretched canvases, canvas panels, canvas pads, canvas rolls (including bulk rolls that have been primed), printable canvases, floor cloths, and placemats) are tightly woven prepared painting and/or printing surfaces.Artist canvas and stretcher strips (whether or not made of wood and whether or not assembled) included within a kit or set are covered by this proceeding.
Artist canvases subject to this investigation are currently classifiable under subheadings 5901.90.20.00 and 5901.90.40.00 of the Harmonized Tariff Schedule of the United States (HTSUS). Specifically excluded from the scope of this investigation are tracing cloths, "paint-by-number'' or "paint-it-yourself'' artist canvases with a copyrighted preprinted outline, pattern, or design, whether or not included in a painting set or kit.Also excluded are stretcher strips, whether or not made from wood, so long as they are not incorporated into artist canvases or sold as part of an artist canvas kit or set. While HTSUS subheadings are provided for convenience and customs purposes, the ITA's written description of the scope of this proceeding is dispositive.
Artist canvases with a non-copyrighted preprinted outline, pattern, or design are included in the scope, whether or not included in a painting set or kit.
ITA to issue preliminary finding on artist canvas primed in India & processed/exported from China. The ITA has not yet determined whether artist canvas primed in India but processed and exported from China is within the scope of this investigation. Nonetheless, the ITA intends to issue a preliminary finding on whether such canvas is within the scope of this investigation. The ITA adds that it will afford interested parties an opportunity to provide comments on its preliminary finding on this issue in their pre-hearing briefs.
Postponement of Final AD Duty Determination
The ITA states that it is postponing its final AD duty determination for subject merchandise from China until no later than 135 days after November 7, 2005 and is also extending the provisional measures accordingly.
