CV: Canada Pure Magnesium and Alloy Magnesium

The International Trade Administration (ITA) has issued the final results of its administrative reviews of the countervailing (CV) duty orders on pure magnesium and alloy magnesium from Canada for the review period of January 1, 2003 through December 31, 2003.

Final Results of CV Duty Administrative Reviews

For entries on or after September 14, 2005, suspension of liquidation will continue for the affected companies at the CV cash deposit rates listed below.

Magnola's rate is for alloy magnesium only.

The ITA will instruct U.S. Customs and Border Protection (CBP) to continue to collect CV cash deposits for non-reviewed companies at the most recent company-specific or country-wide rate applicable to the company (except Timminco Limited, which was excluded from the CV duty orders on pure magnesium and alloy magnesium from Canada).

Assessment Instructions for the Review Period (01/01/03 - 12/31/03)

The ITA states that it will not order the liquidation of entries of pure magnesium or alloy magnesium from Canada exported by NHCI or Magnola on or after January 1, 2003 through December 31, 2003, pending final disposition of a dispute settlement proceeding under the North American Free Trade Agreement (NAFTA).

The ITA also states that liquidation of NHCI and Magnola entries will occur at the rates described in these final results of CV duty administrative reviews, if appropriate, following the final disposition of the previously mentioned NAFTA dispute settlement proceedings.
