AD: Japan Superalloy Degassed Chromium

The International Trade Administration (ITA) has made a preliminary affirmative antidumping (AD) duty determination that superalloy degassed chromium from Japan is being, or is likely to be, sold in the U.S. at less than fair value. The period of investigation is January 1, 2004 through December 31, 2004.

As a result, the ITA will instruct U.S. Customs and Border Protection (CBP) to suspend liquidation of all entries of superalloy degassed chromium from Japan with a time of entry on or after August 18, 2005.

The ITA states that it will also instruct CBP to require a cash deposit or the posting of a bond at the AD rate (equal to the weighted average margin) listed below, for imports of subject merchandise with a time of entry on or after August 18, 2005.

ITA Seeking Scope Comments With Regard to Chromium-Content Parameters

The scope of the investigation remains unchanged since the initiation of this AD duty investigation; however, the ITA states that it received a scope comment which contends that it should revise the language of the scope to clarify that chromium metal with a chromium content either below 99.5% or equal to or above 99.95% is excluded from the scope. The ITA states that at this time, it does not have the technical information to determine whether clear chromium-content parameters exist which define superalloy degassed chromium.

As such, it has not made a decision with respect to this scope comment and continues to evaluate scope comments. The ITA is inviting all interested parties to submit comments with respect to the scope by September 1, 2005 and rebuttal comments by September 7, 2005.
