Export Compliance Daily combines U.S. export control news, foreign border import regulation and policy developments into a single daily information service that reliably informs its trade professional readers about important current issues affecting their operations.

As a result, May 2005 year-ending data (YE May 2005), for the 12-month period of June 1, 2004 - May 31, 2005 is now available for China-origin textiles and apparel, including those subject to safeguard proceedings, which are listed below (except for 359S/659S and 369pt/666pt, for which data is not readily available, and 332/432/632pt, which is currently subject to a safeguard quota and is closed).

Similar April 2005 YE data for the 12-month period of May 1, 2004 - April 30, 2005, is also listed below.

(May 2005 official monthly data for single categories is alsoavailable; see BP Note below.)

Actual 2005 Quota Level for a China Safeguard Implemented in July or August Would Not be Full 12-Month Level but Would be Prorated through End of 2005

If any China safeguard quotas implemented in July 2005. If any China safeguard quota is implemented in the month of July 2005, the quota would be expected to be effective for exports on or after the July date of implementation through December 31, 2005. (Exports before the July date of implementation would not be subject to quota.)

The 12-month quota quantity would equal the YE April 2005 quantity plus 7.5% (or 6% for wool products). However, since the actual quota level would be prorated to the end of the year, through December 31, 2005, the actual quota level would be a fraction of the 12-month quota quantity. (For example, a China safeguard quota implemented at the end of July 2005 would be set at a level approximately 5/12 of the 12-month quota quantity.)

If any China safeguard quotas implemented in August 2005. The same is true for any China safeguard quota that is implemented in the month of August 2005. The quota would be expected to be effective for exports on or after the August date of implementation through December 31, 2005. (Exports before the August date of implementation would not be subject to quota.)

The 12-month quota quantity would equal the YE May 2005 quantity plus 7.5% (or 6% for wool products). However, since the actual quota level would be prorated to the end of the year, through December 31, 2005, the actual quota level would be a fraction of the 12-month quota quantity. (For example, a China safeguard quota implemented at the end of August 2005 would be set at a level approximately 4/12 of the 12-month quota quantity.)

Below is 12-month YE April 2005 and YE May 2005 data for the China categories that are subject to safeguard proceedings (except 359S/659S, 369pt/666pt, and 332/432/632pt) that do not yet have safeguard quotas imposed, as well as various estimated prorated amounts through December 31, 2005, as follows:

BP Notes

1. CITA has previously stated that a China safeguard quota limit would end either: (1) on December 31 of the year in which the consultations were requested, or (2) in cases where three or fewer months remained in the year in which consultations were requested, the limit would end 12 months after the request for consultations. (See ITT's Online Archives or 05/22/03 news, 03052210 for BP summary of CITA's procedures for requesting and imposing China safeguard quotas.)
