AD: Italy Certain Pasta

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty new shipper review of certain pasta from Italy for the review period of July 1, 2003 through June 30, 2004.

Final Results of AD Duty New Shipper Review

Bonding is No Longer Permitted

As a result, the ITA states that bonding will no longer be permitted to fulfill security requirements for shipments of certain pasta from Italy from Atar with a time of entry on or after May 25, 2005.

For shipments with a time of entry on or after May 25, 2005, the ITA has determined the following AD cash deposit rates (equal to the weighted-average margin percentage) apply:

AD Cash Deposit Rate for a Time of Entry On or After 05/25/05:

Atar, S.r.L. (Atar) as both exporter and producer(a)
All others(b), (c), (d)

(a) The ITA has determined that during the period of review, Atar did not sell subject merchandise at less than normal value. As such, entries of subject merchandise both exported and produced by Atar will receive an AD duty rate of zero.

(b) The AD cash deposit rate for exporters who received a rate in a prior segment of this proceeding will continue to be the rate assigned in that segment of the proceeding;

(c) The AD cash deposit rate for entries of subject merchandise exported but not manufactured by Atar will be the all others rate of 11.26% or the rate applicable to the producer, if so established; and

(d) If neither the exporter nor the producer is a firm covered in this review or a prior segment of the proceeding, the AD cash deposit rate will be the all others rate of 11.26%.

Assessment Instructions for the Review Period (07/01/03 - 06/30/04)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days.

The ITA also states that it has calculated importer-specific AD duty assessment rates which, according to trade sources, may differ significantly from the AD cash deposit rates listed above.
