AD: Italy Stainless Steel Bar

The International Trade Administration (ITA) has issued a notice stating that it is preliminarily rescinding the antidumping (AD) duty administrative review of stainless steel bar from Italy covering the period of March 1, 2003 through February 29, 2004 because the only producer/exporter subject to the review, UGITECH S.A. (UGITECH), was preliminarily found to have made no shipments of subject merchandise to the U.S. during the period of review.

Preliminary Rescission of AD Duty Administrative Review

The ITA states that in the course of this AD duty administrative review it has received information sufficient to warrant a successor-in-interest analysis of UGITECH, formerly known as Ugine Savoie-Imphy S.A. (Ugine) for purposes of determining AD duty liabiltity.

ITA Preliminarily Determines that UGITECH Is Successor-in-Interest to Ugine

Specifically, UGITECH submitted documentation to the ITA supporting its claims that its name change resulted in no significant changes in either production facilities, supplier relationships, customer base, or management. Based on an examination of these documents, the ITA preliminarily finds that UGITECH operates as the same business entity as Ugine and is the successor-in-interest to Ugine for purposes of determining AD duty liability.

Therefore, the ITA preliminarily finds that UGITECH should receive the same AD duty treatment with respect to stainless steel bar as Ugine.

The preliminary rescission and the preliminary successor-in-interest finding are not in effect and may be amended in the final results of this AD duty administrative review of stainless steel bar from Italy, which are currently due within 120 days of April 7, 2005.
