AD: China Sebacic Acid

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty changed circumstances review of sebacic acid from China. The ITA has determined that Tianjin resumed dumping of sebacic acid during the July 1, 2002 through June 30, 2003 period of review, as alleged by a domestic interested party.

AD Duty Order Reinstated for One Co

ITA Reinstates Order for Tianjin

The ITA has established that sebacic acid exported by Tianjin is being sold at less than normal value, and as a result states that Tianjin is reinstated in the AD duty order effective March 30, 2005.

The ITA has determined that the following weighted-average margin percentage exists for the period of July 1, 2002 through June 30, 2003:

According to the preliminary results of this AD duty changed circumstances review and the AD/CV query used by U.S. Customs and Border Protection (CBP), the AD duty order was provisionally reinstated and a preliminary AD duty rate of 36.74% was established for sebacic acid exported by Tianjin and produced by Hengshui Dongfeng Chemical Co., Ltd (Hengshui) with a time of entry on or after November 26, 2004. CBP's AD/CV query also indicates that subject merchandise exported by Tianjin and produced by companies other than Hengshui with a time of entry on or after July 1, 2001 is subject to a rate of 243.4%.

The ITA's final results simply state that the order is reinstated for Tianjin. ITA sources indicate that the ITA is currently evaluating these discrepancies between the preliminary and final results.
