2. Dutiability of New China Tax on Certain Textile and Apparel Exports

In its February 2005 Customs Overview, the U.S. Association of Importers of Textiles and Apparel (USA-ITA) discusses the recently imposed, modest China tax on certain of its textile and apparel exports, stating that when the export tax is paid by the exporter and is included in the price of the imported merchandise it is dutiable as part of the price paid or payable. However, when the imported merchandise is appraised based upon the first sale principle and the first sale price does not include the export tax, the export tax may not be (or may be) dutiable. 5. U.S., Canada Block EC Requests for WTO Dispute Panel on Hormone-Treated Beef

The World Trade Organization (WTO) has announced that the U.S. and Canada have blocked the European Communities' (EC's) first-time requests for a dispute panel to be set up in order to examine continued U.S. and Canadian sanctions against the EC's import ban on hormone-treated beef. The WTO notes that while respondents may block a first panel request, a panel is automatically established at the second request. The Department of Homeland Security (DHS) has issued a statement that Assistant Secretary for Border and Transportation Security Policy and Planning C.
