AD: China Magnesium Metal
The International Trade Administration (ITA) has made a preliminary affirmative determination that critical circumstances exist for imports of magnesium metal from China for Tianjin Magnesium International Co., Ltd. (Tianjin, a mandatory respondent), Guangling Jinghua Science and Technology Co., Ltd. (Guangling, the sole Section A respondent), and the China-wide entity.

The ITA also preliminarily determined that critical circumstances do not exist for imports of subject merchandise from China with respect to the RSM companies.
With respect to Tianjin, Guangling, and the China-wide entity, the ITA states that it will direct U.S. Customs and Border Protection (CBP) to suspend liquidation of all unliquidated entries of magnesium metal from China with a time of entry on or after 90 days prior to October 4, 2004, which extends these companies' AD duty liability period by 90 days.
The ITA states that it will issue a final determination concerning critical circumstances for subject merchandise from China when it issues its final determination in the AD investigation on February 16, 2005.
The RSM companies consist of Nanjing Yunhai Special Metals Co., Ltd.; Nanjing Welbow Metals Co., Ltd.; Nanjing Yunhai Magnesuim Co., Ltd.; Shanxi Wenxi Yunhai Metals, Co., Ltd.; Shanxi Wenxi Bada Magnesium Co., Ltd.; Yuncheng Wenxi Welfare Magnesium Plant; and Nanjing Yunhai Metals Plant, which the ITA has previously stated are collapsed and treated as a single entity for purposes of calculating an AD margin in this investigation.
