AD: Brazil Frozen Concentrated Orange Juice
The International Trade Administration (ITA) has issued a notice announcing that it is initiating a changed circumstances review of the antidumping (AD) duty order on frozen concentrated orange juice (FCOJ) from Brazil.

The ITA states that this review is being conducted to determine: (1) if COINBRA-Frutesp., S.A. (COINBRA) is the successor-in-interest to Coopercitrus Industrial Frutesp, S.A. (Coopercitrus), and (2) if COINBRA, like Coopercitrus, is not subject to the AD duty order on FCOJ from Brazil.
The ITA explains that if COINBRA operates as the same business entity as Coopercitrus (with respect to the production and sale of subject merchandise), the ITA will accord COINBRA the same AD treatment as its predecessor.
(According to the ITA, it is alleged that Coopercitrus underwent a change of ownership in 1993, and subsequently changed its name to COINBRA. However, on March 18, 2004, U.S. Customs and Border Protection (CBP) decided to begin requiring payment of AD cash deposits on FCOJ manufactured by COINBRA. Prior to that time, it is asserted that CBP had not required AD cash deposits on COINBRA exports of FCOJ from Brazil.)
The ITA adds that the preliminary results will be published in the Federal Register and it will issue the final results not later than 270 days after January 19, 2005.
In addition, the ITA states that the current requirement for a cash deposit of estimated AD duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of this AD duty changed circumstances review.
