(The ITA has previously noted that Richelain Farms was not selected for individual examination during the CV duty investigation and had requested that the ITA conduct this expedited review.)

ITA Determines to Exclude Richelain from CV Duty Order

The ITA has determined that countervailable subsidies are not being provided to Richelain Farms. Based on these final results, the ITA is excluding Richelain Farms from the CV duty order on hard red spring wheat from Canada.

The ITA states that it will instruct U.S. Customs and Border Protection (CBP) to refund all cash deposits of estimated CV duties collected on all shipments of hard red spring wheat produced and exported by Richelain Farms. In addition, the ITA will instruct CBP to waive cash deposit requirements of estimated CV duties on all shipments of subject merchandise produced and exported by Richelain Farms with a time of entry on or after January 26, 2005.

(See ITA notice for more information, including the scope of the review, etc. See ITT's Online Archives or 11/01/04 news, 04110140, for BP summary of the preliminary results of this expedited CV duty review in which the ITA also determined a CV net subsidy rate of zero.)
