AD: Mexico Gray Portland Cement and Clinker

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of gray Portland cement and clinker from Mexico for the period of August 1, 2002 through July 31, 2003.

Final Results of AD Duty Administrative Review

AD Cash Deposit Rate for a Time of Entry On/After 12/29/04

The ITA continues to determine that it is appropriate to require a per-unit cash deposit amount for entries of subject merchandise produced or exported by CEMEX/GCCC. For all shipments of gray Portland cement and clinker from Mexico with a time of entry on or after December 29, 2004 the cash-deposit amount for CEMEX/GCCC will be $32.85 per metric ton. (The ITA's notice also states that the weighted-average percentage margin is 54.97%.)

(a) for previously investigated or reviewed companies not listed above, the cash-deposit rate will continue to be the company-specific rate published for the most recent period;

(b) if the exporter is not a firm covered in this or any previous AD duty administrative reviews, or the original AD duty investigation, but the manufacturer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; or

(c) the cash deposit rate for all other manufacturers or exporters will continue to be 61.85%

Assessment Instructions for Review Period (08/01/02 - 07/31/03)

The ITA states that it will determine and U.S. Customs and Border Protection (CBP) will assess AD duties on all appropriate entries. The ITA adds that it will issue appropriate assessment instructions directly to CBP within 15 days of December 29, 2004.
