AD: China Petroleum Wax Candles
The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty new shipper review of petroleum wax candles from China for the review period of August 1, 2002 through July 31, 2003.

As a result, the ITA states that bonding is no longer permitted to fulfill security requirements for shipments of petroleum wax candles from China produced/exported by Shandong Huihe that have a time of entry on or after December 29, 2004.
For shipments with a time of entry on or after December 29, 2004, suspension of liquidation will continue at the AD cash deposit rates (equal to the margin percentage) listed below:

ITA sources state that although Shandong Huihe's rate of 108.30% is currently the same as the China-wide rate, Shandong Huihe, as both exporter and producer, is considered to have a separate rate because total adverse facts available were applied. Therefore, if the China-wide rate were to change, Shandong Huihe's rate would not necessarily be affected.
ITA sources state that instructions (a), (b), and (c) were accidentally omitted from its notice.
(a) The AD cash deposit rate for China exporters who received a separate rate in a prior segment of this proceeding will continue to be the rate assigned in that segment of the proceeding;
(b) The China-wide AD cash deposit rate, which includes merchandise exported by Shandong Huihe but not produced by Shandong Huihe will continue to be 108.30%; and
(c) The AD cash deposit rate for non-China exporters of subject merchandise from China will be the rate applicable to the China exporter/producer that supplied that non-China exporter.
Assessment Instructions for the Review Period (08/01/02 - 07/31/03)
According to the ITA, it will determine and U.S. Customs and Border Protection (CBP) will assess AD duties on all appropriate entries. The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of December 29, 2004.
