BP Table Lists Decision Due Dates, Etc. for China Safeguard Petitions

In November and December 2004, the Committee for the Implementation of Textile Agreements (CITA) issued Federal Register notices announcing 30-day comment periods for ten recent petitions requesting new, or the reapplication of, China safeguard quotas on certain textile and apparel imports from China.

(Two other petitions requesting the reapplication of China safeguard quotas for 349/649 and 350/650 have been filed;however, CITA has not yet published notices in the Federal Register announcing 30-day comment periods on these reapplications.1)

CITA Has Up to 60 Days from Comment Due Date to Determine Whether to Impose Safeguard Quotas/Request Consultations

CITA is required to make a determination whether to impose a safeguard quota (and request consultations) for the below categories from China within 60 calendar daysof the 30-day comment deadline for each, as follows:

(Note that for the four safeguard quotas implemented to date, CITA used the entire 60-day period to determine whether to impose the safeguard quotas. It is not known if CITA will continue to use the entire 60-day period to make its determinations.

In addition, for the first three safeguard quotas, CITA waited more than a month after its determination to actually impose the quotas. For the fourth safeguard quota on 332/432/632pt, CITA only waited 7 days after its determination to impose the quota.)

1 On December 24, 2003, CITA established safeguard limits on China cats 349/649 and 350/650 that will expire on December 23, 2004. (At the same time, CITA also established a safeguard limit on China cat 222 for the same period.)

Petitions for the reapplication of safeguard quotas on China cat 349/649 and China cat 350/650 were filed on December 1, 2004.
