India Group II Closed on December 2, 2004

According to U.S. Customs and Border Protection (CBP), India Group II closed on December 2, 2004 at 8:30 a.m.

India Group II will be quota-free for exports on or after January 1, 2005. (All of the quotas imposed on World Trade Organization (WTO) member countries, such as India, are currently scheduled to be quota- and visa-free for exports on/after January 1, 2005. However, safeguard quotas may be imposed on China categories that are entirely or partially integrated.)

India Group II = categories 200, 201, 220, 224-227, 237, 239, 300, 301, 331, 332, 333, 352, 359, 360-362, 603, 604, 611-620, 624-629, 631, 633, 638, 639, 643-646, 652, 659, 666, 845, 846, and 852, as a group.

BP Note on 2004 Overshipments

In June 2004, CITA issued a notice stating, among other things, that it reserves the right under bilateral agreements, the Uruguay Round Agreements Act and the Uruguay Round Agreement on Textiles and Clothing (ATC), to deny entry to goods that have been shipped in excess of the 2004 limits or to stage entry in 2005 to merchandise exported during 2004 which exceed the restraint limit(s) established for that period.

CITA also stated that a properly completed visa, electronic visa (ELVIS) transmission, Guaranteed Access Level (GAL) certification, or exempt certification will be required, as applicable, for all shipments exported in 2004, regardless of the date of entry into the U.S. (See ITT's Online Archives or 06/25/04 news, 04062515, for BP summary of CITA's notice.)
