AD: Japan Polychloroprene Rubber

The International Trade Administration (ITA) has issued its preliminary results of the antidumping (AD) duty changed circumstances review of polychloroprene rubber from Japan to determine whether Showa Denko K.K. (SDK) is the successor-in-interest company to the joint venture of Showa DDE Manufacturing K.K. (SDEM) and DDE Japan Kabushiki Kaisha (DDE Japan) (collectively, the SDEM/DDE Japan joint venture).

Preliminary Results of AD Duty Changed Circumstances Review

The ITA has preliminarily determined that SDK is not the successor-in-interest to the SDEM/DDE Japan joint venture for purposes of determining antidumping (AD) liability in this proceeding.

According to the ITA, the dissolution of the SDEM/DDE Japan joint venture precipitated significant changes to the company ultimately absorbed by SDK. The ITA states that while SDK absorbed the joint venture's production facility and retained its supplier base, SDK's management and corporate structure, selling, and marketing operations, customer base, and price structure are significantly different from those of the SDEM/DDE Japan joint venture.

(The ITA adds that that the final results of this AD duty changed circumstances review are due not later than 270 days after February 23, 2004, the date on which the initiation notice of this changed circumstances review was published. The ITA also notes that interested parties may submit comments on these preliminary results and request a hearing.)
