The ITA states that until completion of the review, it will instruct U.S. Customs and Border Protection (CBP) to allow, at the option of the importer, the posting of a bond or security in lieu of an AD cash deposit for entries of the subject merchandise both produced and exported from China by Jining Jinshan.

Bonding Allowed in Lieu of AD Cash Deposit

(In accordance with certain specified provisions of 19 CFR 351.214(b), the ITA states that Jining Jinshan has provided the required certifications, as well as documentation to initiate this AD duty new shipper review.)

Middleman Dumping Inquiry Also Initiated

According to the ITA, it is also initiating a "middleman dumping" inquiry because after analysis of the sales documentation submitted by Jining Jinshan it believes such a scenario may exist. The ITA adds that if middleman dumping is found, the ITA will calculate an AD margin based on the combination of the price paid by the middleman to the exporter, and the price paid to the middleman from the unaffiliated U.S. customer.
