CPSC Final Rule Adjusts Customs Value/Ex-Factory Price for Certain Disposable Cigarette Lighters

The Consumer Product Safety Commission (CPSC) has issued a final rule, effective April 14, 2004, that adjusts for inflation the Customs Value or ex-factory price for certain disposable cigarette lighters to $2.25 (from $2.00).

CPSC explains that the Safety Standard for Cigarette Lighters (Standard, 16 CFR Part 1210) requires that disposable and novelty lighters meet specified requirements for child-resistance. The Standard also includes labeling, testing, recordkeeping, and reporting requirements for importers and manufacturers.

(Disposable lighters under 16 CFR 1210.2(b)(2)(ii) pertain to refillable lighters that use butane or similar fuels and have a Customs Value or ex-factory price below a threshold value, which was initially set at $2.00.)

The final rule also makes a technical correction to change the term "Wholesale Price Index" to "Producer Price Index" and notes that the specific Producer Price Index currently applicable to cigarette lighters is the Producer Price Index for Miscellaneous Fabricated Products.

Although the effective date of this final rule is April 14, 2004, CPSC sources explain that, according to a January 2004 press release, the higher $2.25 amount has been enforced since March 1, 2004.
